CLASS DESCRIPTION: Colorado’s homeownership affordability gap has pushed brokers to look beyond the traditional 20%-down, fee-simple mortgage. Land leases — where a buyer owns the home but leases the underlying land from a separate landowner — are one of the tools reentering the Colorado market, most visibly through Estately’s land-lease mortgage program now operating in the state. This course equips brokers to recognize a land-lease transaction, understand the Colorado statutes and recording rules that govern leasehold property and broker disclosure duties, and apply the REALTOR® Code of Ethics to the disclosure, marketing, and fiduciary questions land leases raise. Using Estately’s Colorado program as the worked example, brokers leave able to explain a land-lease transaction accurately to a client, spot the legal and ethical issues specific to leasehold property, and know when to bring in additional expertise.
Learning Objectives: Upon completion of this course, participants will be able to:
• Describe how a land lease differs from a fee-simple purchase and identify its core structural terms.
• Explain how Colorado’s affordability landscape has driven renewed interest in land-lease and shared-equity models.
• Identify the Colorado statutes governing recording of leasehold interests, leasehold common interest communities, and a broker’s duty to disclose adverse material facts.
• Apply Articles 1, 2, 4, 9, and 12 of the REALTOR® Code of Ethics to land-lease disclosure, marketing, and representation scenarios.
• Walk a client through the financial trade-offs of a land-lease transaction using a Colorado case study.
• Recognize red flags in a land-lease transaction and know when to refer a client to counsel.
