Learning Objectives include:
– Clarify and reinforce foundational broker duties including disclosure, advisement, documentation, and appropriate referral.
– Conduct a clause-by-clause review of the Exclusive Right to Sell Contract with embedded fiduciary principles.
– Understand the purpose, timing, and strategic use of the Broker Disclosure to Buyer prior to listing engagement.
– Compare and contrast the Exclusive Right to Sell and Exclusive Right to Buy contracts, identifying fiduciary symmetry.
– Identify and resolve challenges around stigmatizing vs. material defect disclosure and licensee limitations.
– Use the embedded NEWCAR principles (without separate framing) to enhance compliance, communication, and client care.
